Jinpeng Family Association Held a Sharing Seminar on the Judicial Interpretation of the General Principles of Civil Code Contracts

On the afternoon of December 11, the Jinpeng Family Association held an internal sharing lecture on the Judicial Interpretation of the General Principles of Civil Code Contracts, and all lawyers and trainee lawyers actively participated in the lecture.

This training was conducted by the trainee lawyer of our firm, Miss HU Weilin.

Hu Weilin, a trainee lawyer, explained in detail the general provisions of Articles 1 to 69 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of the General Principles of Contract of the Civil Code of the People's Republic of China, the conclusion of the contract, the validity of the contract, the performance of the contract, the preservation of the contract, the alteration and transfer of the contract, the termination of the rights and obligations of the contract, the liability for breach of contract and the supplementary provisions one by one with examples.

The Interpretation of the Supreme People's Court on Several Issues Concerning the Application of the General Principles of Contract of the Civil Code of the People's Republic of China is formulated in accordance with the Civil Code of the People's Republic of China, the Civil Procedure Law of the People's Republic of China and other relevant laws and in light of judicial practice in order to correctly hear contract disputes and disputes over creditor's rights and debts not arising from contracts, and protect the legitimate rights and interests of the parties according to law. The typical cases of the formulation and issuance of the judicial interpretation are important for the Supreme People's Court to guide the courts throughout the country to correctly apply the law and unify the judgment standards.

Therefore, in the sharing of this lecture, the lawyers and trainee lawyers of Jinpeng Jiayi Joint Venture studied and thought carefully, actively raised questions, discussed and exchanged them in combination with typical cases, and expressed their full harvest.
